Facts
Jess McCavitt (plaintiff) and Diane Butler worked as officers for Swiss Reinsurance America Corporation (Swiss Re) (defendant). McCavitt and Butler were involved in a romantic relationship. At some point, McCavitt was discharged. McCavitt alleged that the discharge was due to his romantic relationship with Butler. Swiss Re had no antifraternization policy. McCavitt brought suit in the district court against Swiss Re, alleging that Swiss Re had violated New York Labor Law § 201-d, which provided protections for employees from discharge for certain reasons. Swiss Re filed a motion to dismiss. It argued that romantic dating is not protected by the labor statute. The district court granted Swiss Re’s motion to dismiss. McCavitt appealed to the United States Court of Appeals for the Second Circuit.
