Facts
Jodi McClay (plaintiff) sued Airport Management Services, LLC (defendant) for negligence in the United States District Court for the Middle District of Tennessee. The jury returned a verdict that included $930,000 in noneconomic damages. Tennessee had a law that placed a $750,000 cap on jury awards for noneconomic damages. McClay argued that the cap violated her constitutional right to a trial by jury and violated the separation of powers by interfering with the judiciary’s role. The Tennessee Constitution provided that the right to a jury trial was inviolate. The district court certified the question for the Tennessee Supreme Court.
