Facts
McClure (defendant) was charged with murdering his wife. McClure presented evidence that his wife was unfaithful to him, and that this infidelity was the impetus for the murder. To show that he had knowledge of his wife’s infidelity, McClure sought to introduce the fact that a friend had told him of the infidelity. The trial court excluded the friend’s statement as hearsay. McClure was convicted. He appealed.
