Facts
Randall Craig McCravy (defendant) was indicted for attempting to commit burglary at a building owned by Martin Ayers. The indictment alleged that McCravy tried to enter Ayers’s building by shutting off electrical power to the building and climbing the roof. McCravy was convicted and appealed, arguing that the indictment was legally insufficient and alleged no more than mere preparation, which could not sustain the charge of attempted burglary. The appellate court agreed with McCravy and reversed the conviction. The state moved for a rehearing.
