Facts
Kristal McCready and Keith Kerr (plaintiffs) attempted to rent a property owned by Hoffius (defendant), but Hoffius refused because McCready and Kerr were unmarried and planned on living together at the property. Hoffius claimed that unmarried cohabitation violated his religious beliefs. McCready and Kerr brought suit, claiming a violation of the Michigan Civil Rights Act, which provides for individuals’ equal access to housing. The Michigan Court of Appeals found in favor of Hoffius. McCready and Kerr appealed.
