Facts
Robert Fowler (plaintiff) was a manager at a store owned by McCrory Corporation (defendant). McCrory managers told Fowler to stop hiring any Black persons or persons under 35 years old. Fowler refused the directive and was harassed as a result. The Montgomery County Code (county code) authorized a private citizen to sue another private citizen for violations of the county’s employment-discrimination laws. Fowler sued McCrory, seeking money damages and alleging that he was constructively discharged in retaliation for his protest to follow the directive.
