Facts
Michael McDonald and other parents (collectively, McDonald) (plaintiffs) sued gaming companies, including Disney and Kiloo, and app-monetization companies, including AdColony and Chartboost, (collectively, the companies) (defendants) for violation of privacy by intrusion upon seclusion. McDonald alleged that gaming companies placed app-monetization companies’ software into games targeted at children. McDonald alleged that the companies tracked users’ data and online behavior and utilized this personal data to sell targeted advertising without consent. McDonald presented evidence through reports, surveys, and legal materials that the companies’ conduct was highly offensive to a reasonable person. The companies filed a motion to dismiss.
