Facts
Joe McDonald (defendant) distributed methamphetamine. A Hood County Sherriff’s Department (HCSD) officer repeatedly called and texted McDonald about purchasing methamphetamine and ultimately purchased methamphetamine from McDonald. McDonald was arrested, and the State of Texas charged him with delivery of methamphetamine. McDonald entered a guilty plea and was sentenced to 40 years in prison. McDonald subsequently appealed, arguing that his guilty plea was involuntary because it was the product of ineffective assistance of counsel. In relevant part, McDonald argued that he received ineffective counsel because his attorney failed to advise McDonald about the availability of an entrapment defense.
