McFarland v. State Farm Fire and Casualty
United States District Court for the Southern District of Mississippi
2006 WL 2577852 (2006)
Facts
Hundreds of homeowners (homeowners) (plaintiffs) sued State Farm Fire and Casualty (State Farm) (defendant) for property damage incurred during Hurricane Katrina. The homeowners, all of whom held homeowners-insurance policies with State Farm, joined their claims into a single lawsuit. The court entered a sua sponte show-cause order to permit the parties to submit briefs on the issue of whether the homeowners’ claims should be severed into individual lawsuits, and the homeowners and State Farm filed responses.
