Facts
James McGee was exposed to asbestos through his work. McGee became sick as a result of this exposure to asbestos and died on January 28, 2000. McGee’s widow and children (plaintiff) sued McGee’s former employers and manufacturers of asbestos-containing products (defendants) for wrongful death. The complaint sought several categories of damages, including loss of enjoyment of life. The defendants filed a motion in limine to prevent the plaintiffs from seeking damages for loss of enjoyment of life as a separate element of general damages. The trial court denied the motion, and the defendants appealed through a supervisory writ. The court of appeals reversed, and the plaintiffs appealed.
