Facts
Victor Dahar (defendant) leased property to American Snacks, Inc. American Snacks was granted a tax abatement by the city. American Snacks brought a civil suit against Dahar, alleging that Dahar had wrongfully converted a tax abatement check. Dahar contended that the city—and, in particular, the chairman of the board of assessors, John McGranahan (plaintiff)—had improperly granted the tax abatement. Law enforcement officials questioned Dahar about Dahar’s suspicions regarding McGranahan, who was not a party to American Snacks’s suit. McGranahan was arrested, tried for the crime of official oppression, and acquitted on all counts. McGranahan then brought suit against Dahar for libel and slander. Dahar’s motion to dismiss was denied. The New Hampshire Supreme Court granted certiorari.
