Facts
Harry Douglas McIntyre (plaintiff) and Clifford Balentine (defendant) got into a car accident. McIntyre suffered severe injuries. Both men had been drinking prior to the accident and evidence showed that Balentine was speeding. McIntyre brought a negligence suit and the jury determined that both men were equally at fault. Tennessee was a contributory negligence jurisdiction so that jury determination resulted in a judgment for Balentine. The court of appeals affirmed. McIntyre appealed.
