Facts
Michael McKevitt (plaintiff) was being prosecuted in Ireland. McKevitt filed a motion in federal district court in the United States seeking an order requiring certain journalists (defendants) to turn over tape recordings that McKevitt sought to use in his proceeding in Ireland. The recordings contained interviews the journalists had conducted of David Rupert, the key witness for the prosecution according to McKevitt’s motion, for a biography they were writing. Rupert did not object to the turning over of the tapes. The district court granted McKevitt’s request and entered an order compelling production of the tapes. The journalists appealed, arguing that the tapes were privileged under a First Amendment-based reporter’s privilege.
