Facts
McKinney/Pearl Restaurant Partners, L.P. (McKinney) (plaintiff) leased restaurant space from Metropolitan Life Insurance Company (Metropolitan) (defendant). The parties’ lease required Metropolitan to keep the roof and structural system of the restaurant building “in good condition and repair.” McKinney sued for specific performance, arguing that Metropolitan had failed to perform this contractual obligation. Metropolitan denied that it was in breach and moved for summary judgment on McKinney’s request for specific performance. The district court ruled on Metropolitan’s motion.
