Facts
Thomas McLaughlin and George Carver (collectively, the plaintiff employees) (plaintiffs) were employed by Liberty Mutual Insurance Co. (Liberty Mutual) (defendant). The plaintiff employees filed a lawsuit in federal district court, alleging that Liberty Mutual failed to pay them for overtime and seeking to recover the overtime pay under the Fair Labor Standards Act and Massachusetts law. The Fair Labor Standards Act claim was aggregated with claims brought by other employees according to federal law. The plaintiff employees sought to aggregate their Massachusetts law claims by certifying a class action pursuant to Federal Rule of Civil Procedure (FRCP) 23(b)(3). The plaintiff employees identified at least 51 additional employees of Liberty Mutual with similar claims of unpaid overtime who could be included as class members.
