Facts
Alfred McMullin, decedent, established the Alfred McMullin Living Trust for which Michael McMullin (plaintiff) was the successor trustee. The trust dictated that it terminated upon Alfred’s death. The trust held a contract with Thomas Beaver (defendant), and Michael sued on that contract after Alfred’s death. Beaver moved to dismiss Alfred’s suit, arguing that he lacked standing because the trust terminated upon Alfred’s death, which occurred prior to the commencement of Michael’s action. The trial court entered summary judgment for Beaver. Michael appealed.
