Facts
Leizer and William Meister (the Meisters) (defendants) were indicted for burning insured premises with intent to defraud insurance companies. The Meisters objected to the participation of private prosecutors who had been retained by the insurance companies to aid in conducting the prosecution. The prosecuting attorney (plaintiff) represented to the court that the private prosecutors were acting at his request. The court overruled the Meisters’ objection. The Meisters were convicted after trial and appealed.
