Facts
On July 3, 1998, Mello (plaintiff) was injured while working for Big Y Foods (defendant). Part of Mello’s injury included a burn to her right foot and ankle that led to permanent and significant scarring. Mello filed a claim under the state Workers’ Compensation Act and requested benefits for permanent and significant scarring. Big Y Foods agreed to pay for medical treatment, indemnity benefits for missed work, and compensation for 3 percent permanent disability to Mello’s foot, but denied the compensability of scarring to her right foot and ankle. A commissioner later denied Mello’s claim for scarring on her foot, finding that the scarring did not interfere with Mello’s ability to obtain or continue work. After Mello filed a negligence claim in the trial court, the trial court reserved the question of whether the exclusivity provision of the Workers’ Compensation Act violates Article 1, Section 10 of the Connecticut Constitution for appeal.
