Facts
Pabst Brewing Co. (Pabst) (defendant) owned a life estate pur autre vie in the subject property. Shortly after Pabst acquired this interest, factories and railroads increased in the area until the subject property and homestead became an isolated lot and building. As a result, the property lost its value as a residential property. Rent charged as a residence would have been insufficient to pay taxes and insurance. As a result, Pabst destroyed the large home that was on the property and graded down the ground to make the property useful for its commercial purposes. Melms (plaintiff), remainderman of the life estate, sued for waste.
