Facts
The water system in the city of Wichita Falls (the city) (defendant) was operated by the city. Pursuant to Ordinance 10-57, the city provided water service to nonresidents. The city subsequently adopted Ordinance 69-86, which prohibited new connections for water service outside the corporate limits of the city. Those nonresidents who received water service under Ordinance 10-57 continued to receive the service. Ordinance 69-86 ensured that water was available for the development of vacant land within the city’s corporate limits. Billy Melton (plaintiff) lived outside the corporate limits of the city and did not receive water service under Ordinance 10-57. After Ordinance 69-86 was adopted, Melton requested a new connection for water service. The city denied Melton’s request. Melton brought suit, seeking to compel the city to provide water service. The trial court found that the city was not required to provide water service to Melton. Melton appealed.
