Facts
Franco Mercandino (plaintiff) entered an agreement with Devoe & Raynolds, Incorporated (Devoe) (defendant) under which Mercandino would find marketing opportunities in Italy for Devoe’s products. The oral agreement was negotiated in Italy by the parties’ representatives. Mercandino tried to secure marketing opportunities for Devoe, but because Mercandino was ultimately unsuccessful, Devoe refused to pay for his services. Mercandino sued Devoe in an Italian court, and the court issued a default judgment against Devoe. Mercandino then sued Devoe in New Jersey to enforce the default judgment. The trial court entered judgment in Mercandino’s favor. Devoe appealed in the New Jersey Superior Court, Appellate Division, arguing that the Italian court’s judgment was unenforceable because the Italian court lacked jurisdiction.
