Facts
Since 1953, Meridian Mutual Insurance Co. (MMI) (plaintiff) offered personal and commercial lines of insurance, such as homeowner’s insurance and car insurance, throughout the Midwestern states, including Illinois. In 1978, MMI registered the name Meridian with the United States Patent and Trademark Office for use in connection with its insurance services. In 1996, Meridian Insurance Group, Inc. (MIG) (defendant) filed articles of incorporation in Illinois, adopting a corporate name with the word Meridian, and thereafter brokered group health and life insurance policies throughout the Chicago metropolitan area. MMI discovered MIG’s use of the name Meridian months later when it was denied a certificate to do business in Illinois. MMI subsequently filed suit, alleging that MIG’s use of the name Meridian constituted service-mark infringement, unfair competition, and deceptive trade practice. The district court denied MMI’s motion for a preliminary injunction. MMI appealed.
