Facts
Starkey sued Merryweather and Nixan for damage to his machinery and obtained a judgment for £840 that he levied on Merryweather. Merryweather (plaintiff) then sought contribution from Nixan for half of the amount that Merryweather paid Starkey. The trial court ruled against Merryweather, finding no claim for contribution between joint tortfeasors. Merryweather appealed.
