Facts
Michel Trojani (plaintiff) was a French citizen living in a Salvation Army hostel in Belgium. The Salvation Army provided psychosocial assistance to individuals to help them reintegrate into society. Trojani performed various jobs for the Salvation Army for 30 hours a week as part of a socio-occupational reintegration program. In exchange, Trojani received room and board and some money for expenses. Trojani applied for a minimum-subsistence allowance from the Belgian government. Under Belgian law, individuals unable to obtain adequate resources were entitled to a minimum-subsistence allowance. This law included those foreign nationals subject to the guarantee of the freedom of movement for workers under European Union (EU) law. Belgium denied Trojani’s application.
