Facts
Florence Hammonds (defendant) was a real estate agent at Century 21 Realty. As a real estate agent, Hammonds earned commissions by facilitating the sales of other peoples’ properties. Hammonds herself owned two properties: one was her principal place of residence, and the other was located at 24 Mile Road. A state agency was interested in leasing the 24 Mile Road property as a group home for mentally disabled adults. Instead of leasing to the state agency, Hammonds sold the 24 Mile Road property to Nosh Ivanovic. Hammonds used closing documents bearing the Century 21 logo, but Century 21 did not receive a commission from the sale. Further, in Hammonds’s capacity as an owner, the 24 Mile Road property was the only sale Hammonds made within a 24-month period. Michigan Protection and Advocacy Service, Inc. (MPAS) (plaintiff), a disability-rights organization, brought suit against Hammonds, contending that the sale of the 24 Mile Road property to Ivanovic violated the Fair Housing Act (FHA). The district court granted summary judgment in favor of Hammonds. MPAS appealed.
