Facts
Rambus, Inc. (plaintiff) brought a federal-court patent-infringement action against Micron Technology, Inc. (Micron) (defendant). In anticipation of the suit, Rambus deliberately and repeatedly purged its files of large quantities of data that Rambus knew would substantiate the affirmative defenses Micron was likely to raise. Rambus preserved any data that would bolster its own case. Rambus employees acknowledged to each other the impropriety of this conduct. In court, however, the employees gave false testimony designed to misrepresent Rambus’s document-retention program as neutral and innocently motivated. The court found that Rambus had engaged in bad-faith spoliation of evidence and proceeded to consider an appropriate sanction.
