Microsoft Corp. v. United States
United States Court of Appeals for the Second Circuit
829 F.3d 197 (2016)

- Written by Alex Ruskell, JD
Facts
Microsoft Corporation (plaintiff) was served with a warrant under the Stored Communications Act that directed it to reveal customer information related to alleged drug activity. In response, Microsoft revealed information that was within the United States, but much of the sought information was stored on a server in Ireland as part of Microsoft’s normal operations. Microsoft refused to release the information from the servers in Ireland and moved to quash the warrant. The district court refused and found Microsoft in civil contempt. Microsoft appealed to the United States Court of Appeals for the Second Circuit.
