Arkansas Court of Appeals
29 S.W.3d 788 (2000)
- Written by Sean Carroll, JD
Facts
Jimmy Haddock fraudulently acquired a 1986 Corvette and then sold it to Larry Bowen. Bowen then sold the car to Mike Clarkson (defendant). Neither Bowen nor Clarkson knew that Haddock had obtained the car by fraud. Clarkson sold the car to Midway Auto Sales, Inc. (plaintiff). After the sale, the county sheriff confiscated the car. Midway sued Clarkson, alleging breach of warranty of title. The trial court ruled in favor of Clarkson. Midway appealed.
