Facts
Midway Manufacturing Co. (Midway) (plaintiff) produced the immensely popular Galaxian and Pac-Man arcade games. Midway’s units cost several thousand dollars and were sold to arcades and bars. Bandai-Inc. (defendant) began producing and selling its Packri Monster game and its own Galaxian game as handheld units. Bandai’s units cost less than $50 and were sold to the general public through toy stores. Midway sued Bandai for copyright and trademark infringement. Midway filed summary-judgment motions on the issue of trademark infringement of its Galaxian and Pac-Man games. Midway presented evidence that Bandai intentionally titled one of its handheld games Galaxian to capitalize on the popularity of Midway’s Galaxian arcade game. The district court addressed both motions.
