Facts
Oppenheimer & Co., Inc. (defendant) had been found guilty of churning Miley’s (plaintiff) account that he had with Oppenheimer. The district court granted Miley damages to compensate for the commission paid to Oppenheimer, as well as the decline in his portfolio. Oppenheimer then appealed the decision to award damages for the decline in Miley’s portfolio to the Fifth Circuit Court of Appeals.
