Facts
When her daughter died, Marguerite Bullock (defendant) moved into the daughter’s apartment. Bullock concealed her daughter’s death from the landlord, Miller & Desatnik Management Company, Inc. (landlord) (plaintiff), by continuing to make payments in the daughter’s name. The daughter’s month-to-month tenancy agreement made no mention of Bullock, and there was no evidence that the daughter had ever assigned her rights in or sublet the apartment to Bullock. Several years later, the landlord finally learned of the daughter’s death and served Bullock with a notice to vacate the apartment. Bullock did not vacate, and the landlord sued to evict her. The landlord appealed to the trial court’s judgment for Bullock to the California Superior Court, Appellate Division.
