Facts
By license, Insituform of North America (INA) (defendant) held the exclusive right to the patented Insituform process for rehabilitating pipelines. INA granted sublicenses to other companies, including Miller Insituform, Inc. (MII) (plaintiff). INA terminated the agreement with MII after an alleged breach by MII. MII then brought an action against INA in federal district court, alleging monopolization of the market by INA in violation of § 2 of the Sherman Antitrust Act. The court granted summary judgment in favor of INA. MII appealed to the United States Court of Appeals for the Sixth Circuit.
