Facts
Deanna Milligan (plaintiff) rented an apartment that was owned by Chesterfield Village GP, LLC (Chesterfield) (defendant). Milligan signed a lease that contained an exculpatory clause. The exculpatory clause precluded Milligan from bringing any injury claims against Chesterfield and specifically absolved Chesterfield of liability for negligence. Milligan was injured when she fell while saving herself and her children from a fire in the apartment building. Subsequently, Milligan brought suit, contending that her injuries were caused by Chesterfield’s negligence. Chesterfield filed a motion for summary judgment, arguing that the exculpatory clause barred Milligan’s claim. The trial court granted summary judgment for Chesterfield. Milligan appealed.
