Facts
Minden Pictures, Inc. (Minden) (plaintiff), a stock-photography company, entered agreements with photographers to license their works to third parties. The agreements granted Minden the exclusive right to act as the licensing agent for the photographers, though the photographers reserved their rights to use the photographs. Minden granted a license to John Wiley & Sons, Inc. (Wiley) (defendant), a textbook publisher, to use a certain number of stock photographs. Wiley far exceeded the authorized amount. Minden brought a copyright-infringement action in federal district court. The court ruled in favor of Wiley, holding that Minden’s lack of copyright ownership in the photographs resulted in a lack of standing. Minden appealed. The United States Court of Appeals for the Ninth Circuit granted certiorari.
