Facts
Wendy Minnifield (plaintiff) got a tattoo on her chest from Greg Ashcraft (defendant), a tattoo artist at Skin Worx, Inc. (defendant). After it was completed, Ashcraft asked if he could photograph the tattoo for his portfolio, and Minnifield agreed. Ashcraft took two pictures, one that showed only that tattoo and one that also showed Minnifield’s face. Without Minnifield’s permission, Skin Worx had the photo that showed Minnifield’s face published in a tattoo magazine, along with the business’s name and contact information. Several people recognized Minnifield’s photo in the magazine, including one of her family members. Minnifield brought suit against Ashcraft and Skin Worx for invasion of privacy based on commercial appropriation. The trial court granted summary judgment in favor of Ashcraft and Skin Worx, and Minnifield appealed.
