Facts
Robert Mischalski (plaintiff) was a Polish citizen who came to the United States on a visa. Mischalski remained in the United States after his visa expired. Mischalski worked as a car mechanic. One day at the car shop, after hours, Mischalski was working on his friend’s car. Mischalski used the tire jack provided with the car. Both the car and the jack were manufactured by the Ford Motor Company (defendant). The tire jack collapsed while Mischalski was under the car, causing injury. Mischalski brought a products-liability suit against Ford. Ford filed a motion to amend its answer to add as an affirmative defense the fact that Mischalski was an illegal alien and working illegally off the books at the time of the injury.
