Mitchell Brothers Film Group v. Cinema Adult Theater
United States Court of Appeals for the Fifth Circuit
604 F.2d 852 (1979)

- Written by Sarah Holley, JD
Facts
Mitchell Brothers Film Group (plaintiff) owned a properly registered copyright on a film entitled Behind the Green Door. Mitchell Brothers sued Cinema Adult Theater (defendant) for infringement after it had obtained copies of and exhibited the film in theaters without Mitchell Brothers’ permission. During trial, Cinema Adult Theater asserted as an affirmative defense that the film was obscene and that, therefore, under the equitable doctrine of unclean hands, Mitchell Brothers were barred from relief. The district court agreed and denied relief to Mitchell Brothers. Mitchell Brothers appealed.
