Facts
Antoine Mitchell (defendant) and Gregory Ellis attacked Eddy Arias at the bottom of an internal stairway in an apartment building, each armed with a handgun and donning stocking masks. After a brief altercation, Arias broke free, ran upstairs, and was shot in the back by Ellis. Mitchell was charged in a multi-count indictment with a variety of offenses, including conspiracy to commit second-degree murder. At trial, the prosecution argued that Mitchell and Ellis had conspired not just to rob Arias, but to kill him. Mitchell was found guilty on most of the counts, including conspiracy to commit second-degree murder. Mitchell appealed. The court of special appeals affirmed. The Court of Appeals of Maryland granted certiorari to review.
