Facts
Monarch Accounting Supplies, Inc. (Monarch) (plaintiff) leased an office building from William Prezioso (defendant). Prezioso subsequently entered into a lease with an advertising company for the installation of a sign on the office building’s roof. Monarch sued Prezioso for unauthorized use of the property, claiming unjust enrichment based on the fact that Prezioso had not retained control of the roof in the lease. The trial court awarded Monarch (1) one-half of the rent already paid and to be paid in the future by the advertising company to Prezioso and (2) a fee that Monarch had paid to a structural engineer for proper support of the roof sign. Prezioso appealed.
