Facts
Aetna Casualty and Surety Co. (Aetna) (defendant) hired private investigators to interview former employees of Monsanto Co. (Monsanto) (plaintiff) in connection with a lawsuit against Monsanto. According to affidavits filed by former employees of Monsanto who were interviewed by Aetna, the private investigators did not ask the former employees whether they were represented by counsel. Further, the private investigators either did not tell the former employees that they worked for Aetna in connection with a lawsuit against Monsanto or, in some cases, misrepresented who they worked for and the purpose of the interviews. Monsanto filed a motion for a protective order.
