Facts
Dennis Montgomery (plaintiff) was a member of eTreppid Technologies, LLC (eTreppid) (defendant). eTreppid was structured with a manager, directed by a management committee, making all decisions impacting day-to-day operations of the company. Montgomery sued eTreppid for copyright infringement. Montgomery issued several discovery requests to eTreppid. eTreppid asserted the attorney-client privilege in response. Montgomery argued that because he was a member of eTreppid, he was also a client of eTreppid’s attorney and thus eTreppid could not assert the attorney-client privilege against him.
