Facts

Robert Blackwell (defendant) hit Jerrit Moore with his vehicle, injuring him. Jerrit’s father, Terry Moore (Terry) (plaintiff) sued Blackwell for negligence on behalf of Jerrit. At trial, Blackwell called two expert witnesses, Michael Thomson and Terry Harrison. Thomson was the detective who investigated the accident. The trial court permitted Thomson to provide his opinion, over the family’s objection, that Jerrit was probably more at fault than Blackwell for the accident. Harrison was an accident-reconstruction expert. The trial court permitted Harrison to testify, over Terry’s objection, that Blackwell was not at fault for the accident. The family appealed.
