Facts
Moore (plaintiff), a psychic, predicted that Elmer (defendant) would die before the year 1900. Elmer entered into an agreement and provided a note whereby he promised to pay Moore the balance of her mortgage note if her prediction came true. Elmer died before 1900. Moore sued for enforcement of the agreement.
