Moore v. Wesbar Corp.
United States Court of Appeals for the Seventh Circuit
701 F.2d 1247, 217 U.S.P.Q. 684 (1983)
- Written by Eric Miller, JD
Facts
Dennis Moore, George Moore, and Sierra Products, Inc. (the patent owners) (plaintiff) held a patent on a submersible light for boat trailers. The patent owners brought an infringement action against Wesbar Corporation (defendant) in federal district court. The court held that the patent was invalid on the ground of obviousness. The patent owners appealed to the United States Court of Appeals for the Seventh Circuit. Wesbar argued that the appellate court was limited to reviewing the district court’s decision for clear error, as opposed to making an independent judgment of its own.
