Facts
Moorman Manufacturing Company (Moorman) (plaintiff) operated a feed-processing plant. Moorman purchased a grain-storage tank from National Tank Company (National) (defendant) to use at its plant. After a crack developed in the tank, Moorman filed a products-liability claim against National, alleging that the tank was not reasonably safe due to design and manufacturing defects. Moorman sought to recover damages for repairing the tank as well as for the loss of profits or income due to Moorman’s inability to use the tank. National filed a motion to dismiss, and the trial court granted the motion, holding that Moorman could not recover damages only for economic loss on a strict-liability claim. Moorman appealed.
