Facts
Edward Moragne was killed while working on a ship owned by States Marine Lines, Inc. (States Marine) (defendant). Moragne’s wife (plaintiff) brought suit for wrongful death as representative of Moragne’s estate. The court of appeals followed the United States Supreme Court’s decision in The Harrisburg, 119 U.S. 199 (1886) and held that a cause of action for wrongful death does not exist in maritime law.
