Juveniles in state custody in the Texas Youth Council (juvenile inmates) (plaintiffs) filed a class-action lawsuit against the Executive Director of the Texas Youth Council (TYC) and other TYC administrators and employees (TYC administrators) (defendants) alleging violations of their constitutional rights. The juvenile inmates alleged that physical abuse of inmates by facility staff was widespread at many TYC facilities, and that staff would routinely beat, slap, and kick inmates. Additionally, some TYC facilities were segregated racially and on the basis of suspected homosexuality by TYC staff. Several TYC facilities lacked 24-hour nursing services to medically care for juvenile inmates, or a consistent administrative complaint procedure. Juvenile inmates alleged they could sometimes be the subject of intimidation if they attempted to report staff abuse or other problems at TYC facilities. Finally, TYC did not have a system in place to screen prospective employees to ensure they were appropriate for working with juvenile inmates.
