Facts
Harold Morelock (defendant) was having an illicit affair. While drinking and driving, the couple argued about the future of their relationship. When Morelock tossed a beer can out the window, police pulled over the car. Morelock suddenly panicked, shot his lover four times, then shot himself. The court convicted Morelock of first-degree murder despite his defense that he acted without malice. Morelock appealed.
