Facts
Alice Padgett (defendant) owned and operated a bar and restaurant that hosted a children’s charity benefit. The event included a live band, which performed three copyrighted songs without authorization. The copyright holder, Morganactive Songs, Inc. (plaintiff) brought suit in federal district court. Padgett cited the federal Copyright Act’s charitable exemption to liability for infringement. In deposition testimony, Padgett stated that proceeds from the sale of alcoholic beverages were kept by her establishment. In a later affidavit, Padgett claimed that the proceeds from the alcohol sales went to charity.
