Facts
Mrs. Morone (plaintiff) and Mr. Morone (defendant), although unmarried, had lived together as wife and husband for over 25 years and had two children together. Throughout that time, Mrs. Morone performed domestic duties and orally agreed with Mr. Morone that in exchange for such services, Mr. Morone would provide for her and that they would split his business earnings. Mrs. Morone brought suit seeking to recover such earnings, claiming the existence of an express contract, or, alternatively, an implied contract. The trial court dismissed both causes of action and the appellate court affirmed. Mrs. Morone appealed.
